Terms of Service

By accessing or using Funkd ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

The Service is operated by GAMM TRIBE OÜ, registered in Estonia. Contact: team@funkd.app.

Funkd is a web application that allows users to save, organize, and manage links to social media content (reels, videos, posts) from platforms including Instagram, YouTube, and TikTok.

The Service includes an optional Instagram integration that allows users to save content by sending direct messages (DMs) to our Instagram account (@dopend.app).

You must be at least 13 years old to use this Service. By using the Service, you represent that you meet this requirement. If you are under 18, you must have parental consent.

You may sign in using your Meta (Facebook/Instagram) account or email and password. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

You agree to provide accurate information and to keep it updated. We reserve the right to suspend or terminate accounts that violate these terms.

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to gain unauthorized access to any part of the Service.
• Interfere with or disrupt the Service or its infrastructure.
• Use automated tools to scrape or abuse the Service.
• Impersonate another person or entity.
• Save content that infringes third-party intellectual property rights.

You retain ownership of the content you save and organize through the Service. By using the Service, you grant GAMM TRIBE OÜ a limited, non-exclusive license to store and display your saved content solely for the purpose of providing the Service to you.

We do not claim ownership over the original content from third-party platforms (Instagram, YouTube, TikTok, etc.). Compliance with those platforms' terms of service is your responsibility.

The Funkd brand, interface, and software are owned by GAMM TRIBE OÜ and protected by applicable intellectual property laws.

By linking your Instagram account and using the DM feature, you authorize Funkd to:

• Read messages you send to @dopend.app for the purpose of saving linked content.
• Send automated reply messages to your Instagram account.

This feature is subject to Meta's platform policies. We may discontinue or modify the Instagram integration at any time without notice if required by Meta's policies.

We strive to keep the Service available, but we do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be error-free, secure, or uninterrupted.

To the maximum extent permitted by law, GAMM TRIBE OÜ shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including loss of data or profits.

Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim (or €50 if you have not paid anything).

These Terms are governed by the laws of the Republic of Estonia and applicable EU regulations, without regard to conflict of law principles. Disputes shall be resolved in the courts of Tallinn, Estonia.
